Welcome to RetroQuest. The terms "we", "us" and "our" refer to RetroQuest. RetroQuest operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). RetroQuest is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK legislation.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 – Access and Account
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you have the consent of a parent or guardian to use the Services.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
Section 2 – Our Products
We sell used and pre-owned video game hardware, software, and accessories. All items are tested before dispatch. Product condition is described as accurately as possible in each listing, but due to the nature of pre-owned goods, minor cosmetic wear should be expected unless stated otherwise.
We have made every effort to provide an accurate representation of our products in our online stores. However, colours and product appearance may differ from how they appear on your screen due to your device type and settings.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer.
Section 3 – Orders
When you place an order, you are making an offer to purchase. Your order is not accepted until RetroQuest confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address or phone number provided at the time the order was made.
Your purchases are subject to our Refund Policy and your statutory rights as a consumer.
Section 4 – Prices and Billing
All prices are listed in GBP (£) and include VAT where applicable. Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Unless otherwise expressly stated, posted prices do not include shipping or handling charges.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.
Section 5 – Shipping and Delivery
We aim to dispatch orders within the following timeframes:
Monday–Friday: Same day dispatch if ordered before 2pm. Saturday: Same day dispatch if ordered before 11am. Sunday: No dispatch – orders will be dispatched on Monday.
These are targets and not guarantees. All delivery times provided are estimates. Under the Consumer Rights Act 2015, goods must be delivered within 30 days of purchase unless a longer period has been agreed. Once goods have been delivered to you, they are your responsibility.
We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control.
Section 6 – Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. To exercise this right, you must inform us of your decision to cancel by contacting us at team@retroquest.co.
You must return the goods to us without undue delay and in any event within 14 days of informing us of your cancellation. You will bear the cost of returning the goods. Goods must be returned in the same condition as received.
We will reimburse you no later than 14 days after the day on which we receive the returned goods or, if earlier, the day on which you provide evidence that you have returned the goods. We will use the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise.
Section 7 – Refunds and Returns
In addition to your right to cancel described in Section 6, you have statutory rights under the Consumer Rights Act 2015. If goods are faulty, not as described, or not fit for purpose, you may be entitled to a repair, replacement, or refund.
If you receive a faulty (and it was not sold as faulty) or incorrectly described item, please contact us at team@retroquest.co within 30 days of delivery for a full refund.

Section 8 – Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by RetroQuest, its affiliates or licensors and are protected by UK and international intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent.
RetroQuest's names, logos, product and service names, designs, and slogans are trademarks of RetroQuest. You must not use such trademarks without the prior written permission of RetroQuest. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
Section 9 – Optional Tools and Third-Party Links
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsement.
The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party websites. If you decide to access third-party sites, you do so at your own risk. Please review the third-party's policies and practices before engaging in any transaction.
Section 10 – Relationship with Shopify
RetroQuest is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with RetroQuest. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and RetroQuest. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with RetroQuest.
Section 11 – Privacy and Data Protection
We are committed to protecting your personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. All personal information we collect through the Services is subject to our Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located outside the UK, in order to provide services to you. Section 12 – Feedback
If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use.
You represent and warrant that you own or have all necessary rights to all Feedback and that your Feedback will comply with these Terms. We are under no obligation to maintain your Feedback in confidence, to pay compensation for it, or to respond to it.
Section 13 – Errors, Inaccuracies and Omissions
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate, without prior notice (including after you have submitted your order).

You may access and use the Services for lawful purposes only. You may not access or use the Services to: (a) violate any applicable law or regulation; (b) infringe upon the intellectual property rights of others; (c) harass, abuse, or harm any person; (d) transmit false or misleading information; (e) transmit any advertising, spam, or unsolicited communications; (f) impersonate any other person or entity; (g) upload viruses or malicious code; (h) collect or track personal information of others; or (i) interfere with the security or functionality of the Services.
We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
Section 15 – Termination
We may terminate this agreement or your access to the Services at any time without notice. You will remain liable for all amounts due up to and including the date of termination. Termination does not affect your statutory rights.
Section 16 – Limitation of Liability
Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by the Consumer Rights Act 2015; or (d) any other matter for which it would be unlawful for us to exclude or restrict liability.
Subject to the above, to the fullest extent permitted by law, RetroQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or savings, arising from your use of the Services or any products purchased through the Services.
Section 17 – Indemnification
You agree to indemnify, defend and hold harmless RetroQuest, Shopify, and our affiliates, partners, officers, directors, employees, agents, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
Section 18 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the remaining provisions shall continue in full force and effect.
Section 19 – Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and RetroQuest and supersede any prior agreements or communications regarding the Services. The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Section 20 – Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this section shall limit your statutory rights as a consumer, including any right to bring proceedings in the courts of your country of residence.
Section 21 – Changes to Terms of Service
We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes in accordance with applicable law. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
